Terms & Conditions

Only one person may use the account. You may only create one account with us.

You confirm that the information you provide when creating your account is accurate and complete, and that you will update your Account as and when your information changes.
You must be at least 18 years to create an account and access the Service.
We have the right to disable any account, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions.
7. Copyright and trademarks
Copyright in the Material is owned by Tandem or its content suppliers. Unauthorised use of the Material including reproduction, storage, modification, distribution or republication without the prior written consent of Tandem or, where applicable, the respective copyright owner(s) is prohibited.
Our status (and that of any identified contributors) as the authors of content on the Service must always be acknowledged (except where the content is user-generated).
You must not use any part of the content on our Service for commercial purposes without obtaining a licence to do so from us or our licensors.
The names and logos of Tandem and all related product and service names, designs marks and slogans are the trade names, service marks or trademarks of Tandem and may not be used without the prior consent of Tandem.
All works in the nature of databases attract database rights.
8. No text of data mining, or web scraping
You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Service or any services provided via, or in relation to, our Service for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):

Any "robot," "bot," "spider," "scraper" or other automated device, program, tool, algorithm, code, process or methodology used to access, obtain, copy, monitor or republish any portion of our site, or any data, content, information or services accessed via the same.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).
You shall not use, and we do not consent to the use of, our site, or any data published by, or contained in, or accessible via, our Services for the purposes of developing, training, fine-tuning or validating any AI system or model.
This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

So far as permissible by law, Tandem does not accept any liability to any person relating to the use of any such information. Whilst Tandem has taken every precaution in compiling this Service neither it nor any contributors to the Service can be held responsible for any action (or the lack thereof) taken by any person or organisation wherever they shall be based, as a result, direct or otherwise, on information contained in or accessed through this Service.
10. Uploading content to our Service
Whenever you make use of a feature that allows you to create content directly on our Service, upload or share content to our Service, or to make contact with other users of our Service, you must comply with the standards set out in our Acceptable Use Policy set out below.
You warrant that any such contribution complies with our Acceptable Use Policy, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
We will consider any content you upload to our Service to be non-confidential and not protected by any trade mark, patent or copyright, that is, in the public domain. 13. Activities outside of the Services

You acknowledge and agree we, or any university or other partner we work with in connection with the Services (each a “Partner”), will NOT be responsible or liable for the External Events, including the actions or omissions of any users of the Services or third parties at the External Events and you irrevocably release us, the Partner, and each of ours and theirs successors, licensees and assigns from all liability of whatever nature following from or arising as a result of the External Events and warrant that you shall make no claims in respect of the same.

The Service is intended for use by a global audience and much of its content will be applicable wherever you are and whoever you are creating for, but please remember that Tandem is based in England. 15. Limitation of liability
Whether you are a consumer or a business user:

Tandem’s inclusion of links to such websites does not imply any endorsement of the material on such websites or any association with their operators. You are solely responsible for evaluating the accuracy and completeness of any information contained on the third party websites, and also the value and integrity of any goods and services offered by such websites.

19. Viruses
Whilst Tandem makes all reasonable attempts to exclude viruses from the website it cannot ensure such exclusion and no liability is accepted for damage caused through the downloading of viruses. Therefore, you are recommended to take all appropriate safeguards before downloading information from the Service. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with our Service or any part of it. You must not attempt to gain unauthorised access to our Service, the server on which our Service is stored or any server, computer or database connected to our Service or any other equipment or network connected with our Service. You must not interfere with, damage or disrupt any software used in the provision of our Service or any equipment or network or software owned or used by any third party on which this Service relies in any way. 21. Force majeure
Tandem shall not be held to be in breach of its obligations hereunder nor liable to you for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.
22. General

If any provisions of these terms and conditions are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected.

These terms and conditions constitute the entire agreement between Tandem and you and supersede all other (prior or contemporaneous) communications and proposals, whether electronic or written, between you and Tandem.

Any failure of Tandem to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement of any such rights.

Tandem may transfer our rights and obligations under these terms to another organisation.
23. Law and Jurisdiction
The terms and conditions and the use by the User of the Service shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Service and/or any transactions made on the Service, or these terms and conditions.

ACCEPTABLE USE POLICY
Acceptable use
These acceptable use standards apply to any material you upload or share to our site or generate on our Service (User Content). They also apply to any contact you make with other users on our Service, links to our Service, and any other ways you use our Service.
You must comply with these standards in spirit as well as to the letter.
Tandem will determine, in its discretion, whether any User Content or your use of our Service breaches these acceptable use standards.
You may not use our Service:

To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
User Content:

Must be accurate (where it states facts).

Only contain opinions that are genuinely held.

Must comply with the law applicable in any country from which it is posted and to which the website is targeted.
User Content must not:

Be defamatory of any person.

Be obscene, offensive, hateful or inflammatory.

Infringe any copyright, database right or trade mark of any other person.

Include video content that has been or would be likely to be given an R18 certificate by the British Board of Film Classification (BBFC).

Include video content not suitable for BBFC classification.

Include material that might impair the physical, mental or moral development of persons under the age of 18.

Be likely to deceive any person.

Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.

Contain illegal content or promote any illegal content or activity.

Be in contempt of court.

Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.

Be likely to harass, upset, embarrass, alarm or annoy any other person.

Impersonate any person or misrepresent your identity or affiliation with any person.

Give the impression that the User Content emanates from Tandem, if this is not the case.

Advocate, promote, or incite any party to commit, or assist in committing, any unlawful or criminal act (e.g. copyright infringement or computer misuse).

Contain a statement which you know or believe, or have reasonable grounds for believing, would likely be understood by the public as encouragement or inducement to commit, prepare, or instigate acts of terrorism.

Be pornographic.

In addition, you must not use our site in any way that involves the following:

Flashing images when it is reasonably foreseeable that an individual with epilepsy will see it and the sender intended that the individual would suffer harm and the sender has no reasonable excuse for sending the images

Additional provisions for video content
You must comply with our guidance on use of maturity or sensitivity ratings on video content.
For the avoidance of doubt, for any User Content in the form of video content:

You must tell us immediately if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating, and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material).

You must not upload a video containing material likely to incite violence or hatred against a group of persons or a member of a group of persons based on any of the following grounds: sex, race, colour, ethnic or social origin, genetic features, language, religion or other belief, political opinion, membership of a national minority, property, birth, disability, age or sexual orientation.
Advertising
You must not upload, post, create on our site or share content containing any advertising or promoting any services or web links to other sites.
You must not upload a video containing advertising for any of the following:

Cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine
-
Alcoholic drinks that are not aimed specifically at under-18s and do not encourage immoderate consumption of alcohol
Any advertising included in a video you upload must not:

Prejudice respect for human dignity

Include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation

Encourage behaviour prejudicial to health or safety

Encourage behaviour grossly prejudicial to the protection of the environment

Cause physical, mental or moral detriment to persons under the age of 18

Directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity

Directly encourage such persons to persuade their parents or others to purchase or rent goods or services
-
Exploit the trust of such persons in parents, teachers or others
-
Unreasonably show such persons in dangerous situations
You must use the functionality provided on our site to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.
How to complain or report content
You can either:

b) any relevant dates
c) any supporting information or evidence
d) any other information you believe we may reasonably require in order to investigate your complaint -

Reporting content is made on an anonymous basis, so other users cannot tell who made the report.
How we will deal with your complaint or reported content
When content is reported, it is not automatically taken down. Reported content is reviewed in accordance with these guidelines:
